Indian Burial Grounds

This section is a portal to laws and legal issues concerning American Indian burial grounds, mounds and sacred sites, as well as information on burial mound history and preserved sites.

Laws concerning Indian Burial Grounds

Federal Laws
The year was 1986. Warehoused deep in the bowels of the Smithsonian Institution's cultural interests were the remains of almost 18,500 American Indians. Stirred by this outrage, a number of Northern Cheyenne leaders catalyzed other Indian leaders to seek legislation for the repatriation of Native American remains and artifacts. A result of this is NAGPRA. The Native American Graves Protection and Repatriation Act (NAGPRA) is the primary federal legislation pertaining to graves and human remains in archaeological contexts. Here is a brief description of it with links to where you may read the full text, its legislative history, federal statues and regulations, oversight hearings, attempted amendments to NAGPRA and other federal legislation.

Also on this page are links to information on the 1996 24 May, Executive Order 13007 concerning Indian Sacred Sites; Indian Tribes and the Section 106 Review Process; and the American Indian Religious Freedom Act.
